("redchat," "we," "us," "our"). redchat is an 18+ adult platform for chatting with, and creating, fictional AI characters, including uncensored adult (NSFW) text conversation and AI-generated adult imagery. *** ## 1. Adult Eligibility & Age Assurance redchat is strictly for adults. To create an account or use the Services you must be at least 18 years old, or the age of majority in your jurisdiction if that is higher. At signup you must affirm that you meet this requirement. redchat does not knowingly permit anyone under 18 to access the Services. Where a payment processor, app platform, or applicable law requires stronger age assurance for adult content, redchat may require additional verification (for example, a card-based or third-party age check) before granting access to adult features, and may re-verify your age from time to time. If we learn that an account belongs to someone under 18, we will terminate it and delete the associated data, subject to any legally-required retention. You are responsible for keeping your login credentials secure and for ensuring that minors cannot access the Services through your account or device. ## 2. Adult Content Policy — Permitted & Prohibited redchat is NSFW-native. The following framework governs all characters, chats, and images. It is incorporated into these Terms and supplemented by the Community Guidelines. **Permitted for verified adults** * Sexually explicit text roleplay and uncensored erotic/romantic chat with fictional AI characters. * AI-generated adult imagery, including nudity and depictions of sexual activity, involving fictional characters — including characters you create and characters shared by other adult creators. * Kink and fantasy roleplay between clearly-adult fictional characters, within the prohibitions below. **Always prohibited (zero-tolerance — regardless of who created the character or content)** * **Minors / CSAM.** Any sexualization or sexual depiction of a minor or minor-presenting character, including loli/shota, age-regression to a minor, childlike bodies, "aged-up" versions of characters originally depicted as minors, school-child scenarios, and any character whose age is not clearly established as 18+. Realistic or human-like depictions of underage characters are prohibited even when fictional. * **Non-consensual content involving real people.** Sexual content depicting a real, identifiable individual without consent, including deepfakes, face-swaps, "nudify" tools, revenge porn, sextortion, and secretly-recorded intimate imagery. * **Real-world sexual violence, trafficking, and exploitation.** Content that promotes, solicits, or normalizes non-fictional sexual violence, human trafficking, or commercial sexual exploitation. * **Anything illegal** in the jurisdiction in which redchat operates or in which you access the Services. **Edge categories** * **Bestiality.** Sexual content involving real (non-fictional) animals is prohibited. Clearly-fictional, non-human, imaginary species (for example, fantasy or mythological creatures) are exempt from this prohibition. * **Incest / family roleplay.** This category is not separately enumerated as its own prohibited class, but it remains fully subject to every other rule in this policy — most importantly the absolute, zero-tolerance prohibition on any minor or minor-presenting participant — and to applicable law and the discretion of redchat's moderation team. redchat's adult imagery and characters are fully AI-generated (synthetic) and are not recordings or depictions of real human performers; to the extent that record-keeping regimes such as 18 U.S.C. § 2257 apply only to visual depictions of actual human beings engaged in sexually explicit conduct, redchat's synthetic content is not intended to fall within that scope, and in all cases redchat separately and absolutely prohibits any content that depicts, resembles, or is derived from a real, identifiable person without consent. ## 3. User Conduct redchat is an adult platform. Sexually explicit text roleplay and AI-generated adult imagery involving fictional characters are a permitted, core part of the Services for users who have affirmed they are adults (see Section 1 and the Adult Content Policy in Section 2). This permission does not weaken any of the prohibitions below, which apply to every user, every character, and every conversation regardless of who created the character. You agree not to: * Create, upload, request, or share any content that sexualizes, exploits, or endangers a minor in any form. This is a zero-tolerance rule and includes AI-generated, "aged-up," age-regressed, loli/shota, childlike-body, or school-child depictions, and any character whose age is not clearly established as 18 or older. "Fictional" or "just a drawing" is never a defense. * Create or share non-consensual sexual content depicting a real, identifiable person, including deepfakes, face-swaps, "nudify" outputs, revenge porn, secretly-recorded intimate imagery, or the use of a real person's likeness without their consent. * Create content that promotes, solicits, or normalizes real-world sexual violence, sexual assault, human trafficking, or the sexual exploitation of any real person. * Create content depicting bestiality involving real (non-fictional) animals. Fictional, non-human, clearly-imaginary species are not covered by this prohibition (see Section 2). * Impersonate any person or misrepresent your affiliation, or use the Services to harass, threaten, dox, defame, or stalk another person. * Post hate speech, or content that praises or idolizes perpetrators of atrocities or terrorism, or that promotes suicide, self-harm, eating disorders, or drug abuse. * Use the Services to plan, promote, or carry out any illegal act, or any act that is illegal in the jurisdiction in which redchat operates or in which you access the Services. * Rely on the Services for professional legal, medical, or financial advice. * Circumvent, disable, or attempt to defeat age gates, content filters, moderation systems, or other safety features; or attempt unauthorized access to, or interfere with, the Services. Content that violates these Terms, the Adult Content Policy (Section 2), or the Community Guidelines may be removed without prior notice, and the responsible account may be suspended or terminated. ## 4. Content Moderation, Reporting & CSAM Escalation redchat monitors content using a combination of automated systems and human review. This includes automated detection tooling aimed at preventing child sexual abuse material (CSAM) and other prohibited content. Adult chats are private to your account and are not published, but they are not exempt from safety moderation: content may be automatically flagged and reviewed, and you may receive a warning, suspension, or termination even if you believe a particular exchange was acceptable. Every user can report a character, image, message, or account through the in-product reporting tools. Reports are reviewed by redchat's trust-and-safety team, which may remove content, restrict or ban accounts, and take other action at its discretion. redchat maintains a zero-tolerance policy for the sexual exploitation of minors. Suspected CSAM is removed, the responsible account is terminated, and reports are made to the National Center for Missing & Exploited Children (NCMEC) and/or the relevant authorities in the applicable jurisdiction, and redchat will cooperate with lawful requests from those authorities. redchat may preserve related records as required to support such reports even where a user has requested deletion. ## 5. User Content & Creator Ownership You own the original characters, stories, lorebooks, images, and other content you create on redchat. Posting content does not transfer ownership to redchat, and posting content that is not original to you does not make it yours. While your content is published, you grant redchat a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and promote it for the purpose of operating and providing the Services, including displaying your published characters to other adult users. This license ends when you unpublish or delete your content, except that: (a) de-identified snapshots of previously public characters may be retained to preserve other users' existing chats; and (b) copies may be retained where required for legal obligations, security, backups, and abuse or child-safety investigations. Ownership never overrides safety. The prohibitions in Section 3 and the Adult Content Policy in Section 2 apply to all content regardless of who owns or created it. redchat may remove, restrict, or refuse to display any character or content that violates those policies, and owning a character does not create a right to have it hosted, recommended, or monetized. You are responsible for your content and for the consequences of publishing it. If you participate in the Creator Program (Section 6), additional monetization terms apply. redchat does not sell your content to third parties without your explicit permission. ## 6. Creator Program & Monetization Adult users may create characters and, where eligible, share them publicly with other adult users. The way users earn money on redchat is through the Referral Program: when you share your invite link or a character link and someone you referred newly signs up and pays for redchat, you earn 30% of that referred person's payments for a full year (12 months) from their first payment, regardless of who created any character involved. redchat also supports a family referral structure. Participation, eligibility, payout terms, and any fees are governed by the [Referral Program](/redchat.app/policies/referral-program.md) terms incorporated by reference. Creators retain ownership of their original characters as described in Section 5, but earning referral rewards does not exempt any character from the prohibitions in Section 3 and the Adult Content Policy in Section 2. redchat may remove a character from public display, withhold or reverse referral earnings, and suspend a user's referral eligibility for policy violations, at its discretion. Published characters must not sexualize minors, depict non-consenting real people, or otherwise violate these Terms — enforcement applies regardless of a user's referral earnings or character ownership. ## 7. Subscription & Red Points Usage Some redchat features require a paid subscription or Red Points ("RP"), redchat's virtual in-service currency. RP and subscriptions are described, priced, and governed by the Subscription & Refund Policy, which covers pricing, billing cycles, RP balances and expiry, cancellation, and refunds, and is incorporated into these Terms. Because redchat offers adult content, adult features and adult-content purchases are billed **only through redchat's web checkout using specialized adult-friendly payment processors**, and are not sold through Apple App Store or Google Play in-app purchasing, whose policies prohibit this content. RP is a limited, revocable license to use in-service features; it has no cash value, is not transferable outside redchat, and is not a deposit or stored-value/monetary instrument. ## 8. Payments and Taxes Card and alternative payments for redchat are processed by third-party, adult-friendly payment processors (which may include high-risk card acquirers and cryptocurrency processors). redchat does not store your full card number; only the tokenized reference and, where applicable, the last four digits are retained by our processors. All payments are final and non-refundable except where required by law or expressly provided in the Subscription & Refund Policy and Section 9. You are responsible for all applicable taxes. redchat is not responsible for any bank, card-network, currency-conversion, or payment-provider fees you incur. Initiating a chargeback or payment dispute is governed by Section 9; wrongful disputes may result in loss of access to purchased RP and termination of your account. ## 9. Refunds, Red Points & Chargebacks RP and subscription purchases are digital goods delivered immediately and, once RP is spent on a chat, image generation, or other in-service action, it is consumed and non-refundable. Except where required by law or expressly provided in the Subscription & Refund Policy, redchat does not refund RP or subscription fees for unused time, mid-cycle cancellation, downgrades, content you dislike, or moderation actions taken against your account. Cancelling a subscription stops future renewals; access continues until the end of the current billing period. Where local consumer law grants a withdrawal or cooling-off right (for example, the EU/UK 14-day right), redchat honors it as described in the Subscription & Refund Policy, with a deduction for services already consumed. Do not initiate a chargeback or payment dispute without first contacting support. Because RP is consumed on use, a chargeback for already-spent RP is treated as a wrongful dispute: it may result in immediate revocation of remaining RP and premium access, suspension of the account pending investigation, and refusal of future transactions. Genuine fraud or unauthorized-payment claims are excluded from this and should be reported to support so we can investigate. ## 10. Account Suspension & Termination redchat may suspend or terminate your account, with or without notice, for any violation of these Terms, the Adult Content Policy (Section 2), or the Community Guidelines, or where your account presents a risk to other users or to the platform. Enforcement is carried out as described in Section 4 (Content Moderation, Reporting & CSAM Escalation), and may range from content removal to permanent account termination. Upon termination, your access to the Services ends and the license you granted us in Section 5 ends, except for the de-identified snapshot and legally-required retention described in Section 5 and the Privacy Policy. Termination of an account does not by itself transfer ownership of your content to redchat. Conduct that involves the sexual exploitation of minors will result in immediate termination and reporting to the appropriate authorities as described in Section 4. ## 11. Privacy Your use of redchat is subject to the Privacy Policy and the Cookie & Analytics Notice, which explain what data we collect and how we use and protect it. Because redchat is an adult service, we treat your chat conversations and any AI-generated intimate images you create as **sensitive / special-category personal data**. redchat does not sell this intimate data, and does not share your NSFW chat content or generated intimate images with advertising networks or general-purpose analytics vendors whose terms prohibit adult content. Chat and image content is stored on redchat's systems and may be processed by our AI model providers and hosting subprocessors to deliver the Services and to detect prohibited content (including automated CSAM detection). We apply encryption in transit and at rest and access controls appropriate to sensitive data. Depending on your location, you have rights under the GDPR, UK GDPR, and/or the CCPA/CPRA — including rights to access, correct, and delete your data and to request deletion of your account. Legally-mandated retention (for example, records related to a child-safety report) may survive a deletion request. Full details, retention periods, subprocessors, and how to exercise your rights are in the Privacy Policy. ## 12. Third-Party Services redchat relies on third-party providers to operate, including adult-friendly payment processors, cloud hosting, and the AI model providers that generate character responses and imagery. Where a third party processes your content, we use providers whose terms permit adult content, and we limit what is shared to what is necessary to deliver the Services. redchat may use privacy-respecting analytics to understand aggregate product usage. We do not send your NSFW chat content, your generated intimate images, or the sexual context of your activity to advertising networks or to general analytics vendors whose policies prohibit adult content; analytics is limited to non-intimate, aggregated usage and diagnostic signals. redchat is not responsible for the content or privacy practices of third-party services you choose to visit or connect. Third-party sign-on and processing are described in the Privacy Policy. ## 13. Intellectual Property All redchat content and software, excluding user-generated content, is owned by PowerFan Inc. or its licensors and is protected by intellectual-property laws. "redchat" and associated names, logos, and trademarks belong to PowerFan Inc.. Nothing in these Terms grants you any right to use redchat's marks without our prior written permission. Your rights in the content you create are addressed in Section 5. ## 14. Disclaimers The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, to the maximum extent permitted by law. ## 15. Limitation of Liability redchat is not liable for indirect, incidental, special, or consequential damages, or loss of data or profits. Our total liability shall not exceed the greater of $100 or the amount you paid us in the past 12 months. ## 16. Indemnification You agree to indemnify and hold harmless redchat, its affiliates, employees, and agents from claims, losses, damages, or expenses arising from your content or your violation of these Terms. ## 17. Governing Law & Dispute Resolution These Terms are governed by the laws of the State of Nevada, U.S.A., without regard to conflict-of-laws rules. Except where prohibited by your local law, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by JAMS under its streamlined/expedited rules, seated in Las Vegas, Nevada. To the maximum extent permitted by law, you and redchat each waive any right to a jury trial and agree that disputes will be resolved only on an individual basis and not as a plaintiff or class member in any class or representative proceeding. Either party may still seek injunctive relief to protect intellectual-property rights or bring an individual claim in small-claims court where available. Payment disputes and chargebacks are additionally governed by Section 9. **Arbitration opt-out:** you may opt out of the arbitration and class-waiver provisions by emailing within 30 days of first accepting these Terms; opting out does not affect any other provision of these Terms. ## 18. Modifications to Terms redchat may update these Terms at any time. Material changes are communicated via the Services or email. Continued use constitutes acceptance. ## 19. Miscellaneous Entire Agreement; Severability; No Waiver; no assignment by you without our consent. ## 20.
